For any disputes arising from a contract with a consumer, the competent courts will be those of the consumer's domicile. In all other cases, the courts of Madrid will be applicable unless otherwise provided by law.

The present General Terms of Use, Terms of Sale, and Privacy Policy regulate the use of the website www.yuxus.com (hereinafter "the Website"), which YUXUS makes available to users.

Descriptions, images, and other details of the products offered on the Website are provided for information purposes only and may vary slightly from reality.

All product prices shown on the Website are inclusive of VAT (where applicable) at the current rates and are correct at the time the information is entered into the system. However, YUXUS reserves the right to change prices at any time without prior notice.

Payments can be made via Visa, MasterCard, American Express, Apple Pay, Google Pay, Maestro, iDEAL, Bancontact, Shop Pay, PayPal, or Klarna in three interest-free installments.

Shipping costs, delivery times, and other related information are detailed in the Shipping Policy.

Users have 15 days from receipt of goods to request an exchange or return in accordance with the Returns & Exchanges Policy.

All content on the Website (illustrations, texts, names, brand names, images, videos) is the property of YUXUS. Any partial or total reproduction by any means is subject to prior and express authorization by YUXUS.

YUXUS shall not be liable for damages of any kind that may arise from the misuse of the Website or its contents by users.

Personal data provided by users will be treated in accordance with the Privacy Policy.

YUXUS reserves the right to modify these Terms and Conditions at any time. Users will be bound by the Terms and Conditions in force at the time they place an order or use the Website.

The loyalty programme "YUXUS Rewards" (hereinafter "the Programme") is owned and operated by GFA Group S.L., with registered office at Calle Fuencarral 74, 28004 Madrid, España, and with Tax ID B67870154 (hereinafter "YUXUS").

These Terms and Conditions (hereinafter "T&C") govern participation in the YUXUS Rewards loyalty programme, a free rewards programme that allows Members to earn points through various activities and redeem them for discount coupons applicable to purchases of YUXUS products at the online store (www.yuxus.com) and at the physical store.

Member: Any natural person who registers and is accepted into the Programme.
YUXUS Points: Accumulation units with no monetary value, redeemable only for Programme rewards.
Tier: Membership category determining additional benefits.
Discount Coupon: Reward obtained by redeeming YUXUS Points, consisting of a discount applicable to a purchase.
Member Account: Individual digital record containing the Member's point balance, tier, activity history and personal data.

4.1. Any natural person aged 14 or over may register for the Programme, in accordance with Article 7 of Spanish Organic Law 3/2018 on Personal Data Protection (LOPDGDD). Members under 18 declare that they understand these T&C and are aware of their rights.

4.2. Registration is free and may be completed through the online store (www.yuxus.com) or at the physical store.

4.3. Each natural person may hold one single Member Account. Accounts are nominative, personal and non-transferable.

4.4. The Programme is not retroactive: purchases made prior to the date of registration will not generate YUXUS Points and will not count towards Tier progression.

4.5. By registering, the Member accepts these T&C and confirms having read the Programme's Privacy Policy. Consent to receive commercial communications by email or other channels is voluntary and does not condition participation in the Programme.

5.1. The Programme has five membership tiers, each with differentiated benefits:

5.2. Tier freeze due to inactivity: If a Member does not make any purchase for a continuous period of 12 months, the benefits associated with their current Tier will be temporarily frozen. During the freeze, the Member will retain their YUXUS Points balance but will not be able to enjoy their Tier benefits. YUXUS will send informational notices to the Member at 9, 11 and 11.5 months of inactivity.

5.3. Reactivation: The Member may reactivate their Tier benefits at any time by making a new purchase at the online or physical store.

6.1. Members may earn YUXUS Points in the following ways:

6.2. Points for purchases are calculated on the net amount actually paid (after discounts, excluding shipping). Rounding is to the nearest lower whole number.

6.3. Points will be credited to the Member's Account within a maximum of 48 hours from the corresponding activity.

6.4. In the event of a product return, the points associated with that purchase will be deducted from the Member's balance. If the balance becomes negative, the Member must earn points until reaching a positive balance before being able to redeem.

7.1. YUXUS Points may be redeemed for discount coupons applicable to purchases at the online or physical store, according to the redemption table available at the Programme page.

7.2. Discount coupons have the following characteristics:

• Single use: each coupon may only be used once.
• Valid for 30 calendar days from issuance.
• Not combinable with other Programme discount coupons, unless expressly indicated otherwise.
• Non-transferable to other Members.

7.3. Redeemed points are non-refundable. Once a redemption is confirmed and the coupon issued, the points used cannot be returned to the Member's Account. The Member will be informed of this condition before confirming each redemption.

7.4. Return exception: If the Member returns a product purchased using a discount coupon, the corresponding YUXUS Points will be restored, provided the return is made within the legal period.

7.5. YUXUS Points do not constitute a means of payment, have no monetary value and are not redeemable for cash. Points do not generate interest or credit rights.

8.1. YUXUS does not guarantee the uninterrupted availability of the Programme in the event of technical incidents or force majeure, although it will make its best efforts to restore the service as soon as possible.

8.2. Programme discount coupons may be combined with general promotions in the store, unless expressly indicated otherwise in the specific promotion conditions.

8.3. YUXUS reserves the right to verify Member identity and the accuracy of information provided. In case of fraudulent use, duplicate accounts or activities contrary to these T&C, YUXUS may suspend or cancel the Member's Account, after a reasoned communication.

9.1. YUXUS reserves the right to modify these T&C, including the tier structure, point equivalences and available rewards, when any of the following justified causes applies: (a) changes in applicable legislation; (b) operational or technological needs; (c) market conditions; (d) improvement of services offered to Members.

9.2. Any modification will be communicated to Members with a minimum of 30 calendar days' notice before its entry into force, by email and publication at www.yuxus.com.

9.3. Members who disagree with the modifications shall have the right to withdraw from the Programme without penalty before the modifications take effect. Accumulated points may be redeemed during a 30-day grace period.

9.4. Continued participation in the Programme after the modifications take effect shall imply acceptance of the new T&C.

10.1. The Programme has indefinite duration.

10.2. The Member may withdraw from the Programme at any time without justification, by email to info@yuxus.es or through their account at www.yuxus.com. Withdrawal will be effective within 48 hours.

10.3. Upon voluntary withdrawal, unredeemed YUXUS Points will be lost, except for coupons already issued and within their validity period, which may continue to be used.

10.4. YUXUS may terminate the Programme early by notifying Members with a minimum of 60 calendar days' notice, during which Members may redeem their accumulated points.

10.5. For online registrations, the Member has a 14 calendar day right of withdrawal from the registration date, in accordance with Royal Legislative Decree 1/2007. To exercise it, simply contact info@yuxus.es.

11.1. YUXUS, as data controller, will process Members' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). The processing of data necessary for Programme management is based on performance of the contract constituted by these T&C (Art. 6(1)(b) GDPR).

11.2. Full information about personal data processing, including purposes, legal bases, recipients, international transfers, retention periods and data subject rights, is available in the YUXUS Rewards Privacy Policy.

11.3. Members may exercise their rights of access, rectification, erasure, restriction of processing, portability and objection by sending a request to info@yuxus.es.

11.4. The sending of commercial communications by email or any other electronic channel requires the prior, express and separate consent of the Member, in accordance with Article 21 of Spanish Law 34/2002 on Information Society Services (LSSI-CE). This consent is independent of Programme participation and may be withdrawn at any time.

12.1. YUXUS shall not be liable for service interruptions due to force majeure, technical failures beyond its control, or third-party actions, although it will make its best efforts to minimise any impact on Members.

12.2. This clause shall in no case limit the rights recognised to consumers and users by applicable legislation, nor exclude YUXUS's liability for wilful misconduct or gross negligence.

The names "YUXUS" and "YUXUS Rewards", as well as the logos, designs and graphic elements associated with the Programme, are the property of YUXUS and are protected by applicable intellectual and industrial property legislation.

14.1. These T&C are governed by Spanish law.

14.2. For the resolution of any dispute arising from the Programme, the courts and tribunals of the consumer's domicile shall have jurisdiction, in accordance with applicable legislation.

14.3. The Member may use the out-of-court dispute resolution procedures provided for by Spanish Law 7/2017. For online purchases, the EU Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr/

14.4. YUXUS provides the following complaint channels: email info@yuxus.es and postal address at the registered office indicated in clause 1.

15.1. If any clause of these T&C is declared null or ineffective, the remaining clauses shall retain their full validity.

15.2. YUXUS's tolerance or failure to enforce strict compliance with any condition shall not constitute a waiver of its right to enforce it in the future.

15.3. These T&C are available in Spanish and English. In case of discrepancy, the Spanish version shall prevail.
